用户协议

欢迎使用 Draw Studio（以下简称"本平台"）。本协议是您与本平台之间关于使用本平台服务的约定。在注册或使用本平台服务前，请您仔细阅读并充分理解本协议的全部内容，特别是免除或限制责任、争议解决等条款。一旦您勾选同意、点击"继续 / 登录 / 注册"，以手机号或第三方账号登录，或开始使用本平台服务，即表示您已阅读、理解并同意接受本协议及《隐私政策》的全部条款。

一、服务内容

  1. 本平台基于人工智能技术，向您提供包括但不限于以下在线服务：AI 图像生成与编辑（文生图、图生图、参考图、局部重绘、拆分图层等）、AI 视频生成、画布编辑与导出、对话式创作助手、电商美工（商品图、模特试穿、详情页、营销海报等）、素材库、项目管理、团队协作、作品广场以及帮助与公告等配套功能。
  2. 生成能力由本平台接入的第三方 AI 模型提供。不同模型的能力、可用性、生成质量与积分价格以本平台页面展示为准，并可能随模型供应商的调整而变化。
  3. 本平台有权根据业务发展、法律法规或模型供应商的变化，随时调整、增加、暂停或终止部分服务内容，并在合理范围内提前公告。

二、账号

  1. 注册与登录方式：您可通过用户名 / 邮箱与密码、手机号短信验证码，或本平台接入的第三方账号（如微信、QQ 或其他 OAuth 账号）注册和登录。使用手机号或第三方账号首次登录时，本平台将为您自动创建账号。本平台可能要求邮箱验证码以完成注册。
  2. 信息真实：您应保证注册时所提供的信息真实、准确、完整，并在信息变更时及时更新。
  3. 账号安全：您应妥善保管账号、密码及验证码，不得将账号出借、出售或转让给他人，并对账号下的一切行为承担责任。如发现账号被盗用，应立即通过账号设置修改密码或联系本平台。
  4. 邀请：本平台可能提供邀请注册功能。通过邀请链接或邀请码注册的，邀请人与被邀请人的奖励积分数额、有效期及每人邀请上限，以本平台届时公布的规则为准。以刷号、自我邀请等方式骗取奖励的，本平台有权收回相关积分并限制账号。
  5. 账号注销：您可在账号设置中申请注销账号。为防止误操作，注销申请设有冷静期（具体时长以页面提示为准），冷静期内您可以撤销申请；冷静期届满后账号将被注销，账号下的项目、素材、生成结果、积分余额及未完成的订单权益将不可恢复。

三、积分与付费

  1. 计费单位：本平台采用积分作为服务计费单位。每次生成、编辑或使用对话式创作等功能所消耗的积分数额，以功能页面或模型定价的展示为准。
  2. 积分来源：积分可通过购买套餐、注册赠送、每日签到、邀请奖励、卡密兑换、团队分配等方式获得。除购买获得的积分外，赠送类积分可能设有有效期，到期未使用的部分自动失效；具体以积分明细页面为准。
  3. 扣减与返还：积分在任务提交时扣减。因本平台或模型供应商原因导致任务失败的，本平台按规则返还相应积分；因您提交违规内容被拒绝的，是否返还以本平台规则为准。
  4. 支付：您可通过本平台接入的第三方支付渠道（如支付宝、微信支付、Stripe 等）购买套餐。支付由相应支付机构处理，本平台不接触您的银行卡或支付账户密码。订单在规定时限内未完成支付的将自动关闭。
  5. 退款与发票：除法律法规另有规定或本平台另有承诺外，已消耗的积分及已购买的虚拟商品不支持退款。如本平台开放退款或开票申请，具体条件与流程以页面说明为准。
  6. 团队积分：如您加入或创建团队，团队管理员可将团队积分池中的积分分配给成员使用；团队解散时剩余积分按规则返还。团队内的操作由相应成员负责。
  7. 您不得以任何技术手段或非正常方式获取积分、套利或干扰计费。

四、用户内容与知识产权

  1. 输入内容：您对自己输入的提示词、上传的图片、视频、商品与人物素材等内容负责，并保证拥有相应权利或已获得合法授权（包括但不限于肖像权、著作权、商标权）。上传他人肖像用于试穿、换装等功能前，您应已取得该人的同意。
  2. 生成内容：在遵守法律法规及本协议的前提下，您对通过本平台合法生成的图像、视频内容享有相应使用权利，具体以本平台届时公布的规则及所用模型供应商的条款为准。您理解不同用户使用相似提示词可能得到相似结果，本平台不保证生成内容的唯一性。
  3. 授权本平台：为向您提供服务，您授权本平台在服务所需范围内存储、传输、处理和展示您的输入内容与生成内容，包括将其发送给相应的 AI 模型供应商以完成生成。
  4. 作品广场：您可选择将作品投稿至作品广场。投稿即表示您同意本平台在平台内公开展示该作品及其提示词等信息，并可能将其用于平台的推荐与展示。您可随时撤回已发布的作品。
  5. AIGC 标识：依据相关法律法规，本平台会在生成内容上添加显式标识（角标、水印）和隐式标识（文件元数据）。您不得删除、篡改或隐匿这些标识，也不得将生成内容冒充为真实拍摄或人工创作用于误导他人。
  6. 本平台的软件、界面、商标、模板、技能包及相关技术的知识产权归本平台或相应权利人所有，未经许可不得复制、修改、反向工程或用于开发竞争性产品。

五、用户行为规范

您承诺不会利用本平台从事以下行为：

  1. 生成、上传或传播违反法律法规、危害国家安全、淫秽色情、暴力恐怖、赌博、邪教迷信、虚假信息、侵犯他人合法权益的内容；
  2. 生成或使用他人肖像、声音进行诈骗、诽谤、骚扰或其他侵害他人权益的行为；
  3. 侵犯他人知识产权、肖像权、隐私权、名誉权等合法权益；
  4. 使用爬虫、脚本、多账号或其他自动化手段批量调用服务、绕过频率限制或扰乱平台秩序；
  5. 探测、破坏平台安全，或利用平台漏洞获取不正当利益；
  6. 其他违反法律法规、公序良俗或本协议的行为。

本平台会通过敏感词过滤、提示词语义审查等技术手段对输入内容进行合规审查，并可能保留审查记录。对违规内容及账号，本平台有权采取拒绝生成、删除内容、限制功能、冻结积分、封禁账号等措施，并在法律要求时向有关部门报告。

六、免责声明

  1. AI 生成内容由模型自动产生，可能存在不准确、不完整或与预期不符的情况。本平台不对生成内容的准确性、合法性、适用性或商业价值作出保证，您应自行判断并承担使用风险。
  2. 本平台依赖第三方模型供应商、对象存储、支付、短信等服务，因该等第三方服务中断、变更或终止，或因不可抗力、网络故障等非本平台原因导致的服务异常、延迟或数据丢失，本平台在法律允许范围内不承担责任。
  3. 本平台会尽合理努力保障服务稳定，但不保证服务不中断、无错误。本平台可能因维护、升级临时中止服务，并尽量提前通知。

七、协议的变更与终止

  1. 本平台有权根据需要修订本协议。修订后的协议将在平台公布，并可能通过版本号更新要求您重新确认同意；公布后即生效。
  2. 若您不同意修订内容，应停止使用本平台服务并可申请注销账号；继续使用视为接受修订后的协议。
  3. 如您严重违反本协议，本平台有权立即终止向您提供服务，且不退还剩余积分。

八、法律适用与争议解决

本协议的订立、效力、解释及争议解决均适用中华人民共和国法律。因本协议产生的争议，双方应友好协商解决；协商不成的，任何一方可向本平台运营方所在地有管辖权的人民法院提起诉讼。如本协议部分条款被认定无效，不影响其他条款的效力。

Terms of Service

Welcome to Draw Studio (the "Platform"). These Terms are the agreement between you and the Platform for your use of its services. Please read and make sure you understand them in full before signing up or using the Platform, in particular the sections on disclaimers and dispute resolution. By ticking the consent box, clicking "Continue", "Sign in" or "Create account", signing in with a phone number or third-party account, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and the Privacy Policy.

1. Services

  1. The Platform uses artificial intelligence to provide online services including, without limitation: AI image generation and editing (text-to-image, image-to-image, reference images, inpainting, layer splitting and more), AI video generation, canvas editing and export, a conversational creative assistant, e-commerce visuals (product shots, virtual try-on, detail pages, marketing posters), an asset library, project management, team collaboration, a public showcase, and supporting features such as help and announcements.
  2. Generation is performed by third-party AI models the Platform integrates. Each model's capabilities, availability, output quality and credit price are as shown on the Platform and may change as providers change.
  3. The Platform may adjust, add, suspend or discontinue services at any time as its business, the law or model providers require, and will give reasonable notice where practical.

2. Accounts

  1. Signing up and in: you can sign up and sign in with a username / email and password, a phone number and SMS code, or a third-party account the Platform supports (such as WeChat, QQ or another OAuth account). Signing in with a phone number or third-party account for the first time creates an account for you automatically. The Platform may require an email verification code to complete registration.
  2. Accurate information: the information you provide when registering must be true, accurate and complete, and you must keep it up to date.
  3. Account security: keep your account, password and verification codes safe; do not lend, sell or transfer your account. You are responsible for all activity under your account. If your account is compromised, change your password in account settings or contact the Platform immediately.
  4. Invitations: the Platform may offer referral sign-ups. For accounts created through an invitation link or code, the bonus credits for inviter and invitee, their validity and the per-user invitation cap are governed by the rules the Platform publishes at the time. The Platform may claw back credits and restrict accounts that obtain rewards through fake accounts, self-referral or similar abuse.
  5. Deleting your account: you can request account deletion in account settings. To guard against mistakes, deletion has a cooling-off period (shown on the page) during which you can cancel; once it ends the account is deleted and its projects, assets, generated content, credit balance and outstanding order benefits cannot be recovered.

3. Credits and payment

  1. Billing unit: credits are the Platform's billing unit. The credits consumed by each generation, edit or conversational request are shown on the feature page or in the model pricing.
  2. Sources of credits: credits can be obtained by purchasing a package, as a sign-up gift, through daily check-in, referral rewards, redeem codes and team allocation. Except for purchased credits, granted credits may carry an expiry date, after which any unused balance lapses; see your credit history for details.
  3. Deduction and refund of credits: credits are deducted when a task is submitted. If a task fails because of the Platform or a model provider, the Platform refunds the credits under its rules; whether credits are refunded for a task rejected as non-compliant is governed by the Platform's rules.
  4. Payment: packages can be bought through the third-party payment channels the Platform integrates (such as Alipay, WeChat Pay or Stripe). Payments are processed by the respective payment institution; the Platform never handles your card or payment-account credentials. Unpaid orders are closed automatically after the stated time limit.
  5. Refunds and invoices: unless required by law or otherwise promised by the Platform, credits already consumed and virtual goods already purchased are non-refundable. Where the Platform offers refund or invoice requests, the conditions and process are as described on the page.
  6. Team credits: if you create or join a team, the team administrator may allocate credits from the team pool to members; remaining credits are returned under the rules when a team is dissolved. Each member is responsible for their own actions within the team.
  7. You must not obtain credits, arbitrage or interfere with billing through technical or other improper means.

4. Your content and intellectual property

  1. Input: you are responsible for the prompts, images, videos, product and person materials you submit, and you warrant that you hold the necessary rights or licences (including portrait, copyright and trademark rights). Before uploading another person's likeness for try-on or outfit features, you must have that person's consent.
  2. Generated content: subject to applicable law and these Terms, you hold the applicable rights to use the images and videos you lawfully generate through the Platform, as detailed in the rules the Platform publishes and the terms of the model provider used. You understand that similar prompts from different users may yield similar results; the Platform does not guarantee uniqueness.
  3. Licence to the Platform: to provide the services, you grant the Platform the right to store, transmit, process and display your input and generated content to the extent needed, including sending it to the relevant AI model provider to perform generation.
  4. Showcase: you may submit works to the public showcase. Submitting means you agree that the Platform may display the work and related information such as its prompt publicly within the Platform and feature it in recommendations. You can withdraw a published work at any time.
  5. AI-generated content labels: as required by law, the Platform adds explicit labels (corner marks, watermarks) and implicit labels (file metadata) to generated content. You must not remove, alter or hide these labels, nor pass generated content off as photography or human work in a misleading way.
  6. The Platform's software, interface, trademarks, templates, skill packs and related technology are the intellectual property of the Platform or its licensors and may not be copied, modified, reverse engineered or used to build a competing product without permission.

5. Acceptable use

You agree not to use the Platform to:

  1. generate, upload or distribute content that breaks the law, endangers national security, is obscene, violent, terrorist, gambling-related, cult-related or false, or infringes the rights of others;
  2. generate or use another person's likeness or voice for fraud, defamation, harassment or any other violation of their rights;
  3. infringe intellectual property, portrait, privacy, reputation or other lawful rights of any person;
  4. use crawlers, scripts, multiple accounts or other automation to bulk-call the services, bypass rate limits or disrupt the Platform;
  5. probe or attack the Platform's security, or exploit vulnerabilities for gain;
  6. do anything else that violates the law, public order and morals, or these Terms.

The Platform screens input for compliance through measures such as sensitive-word filtering and semantic prompt review, and may keep review records. For non-compliant content or accounts the Platform may refuse generation, remove content, restrict features, freeze credits or suspend the account, and report to authorities where the law requires.

6. Disclaimer

  1. AI-generated content is produced automatically by models and may be inaccurate, incomplete or differ from what you expect. The Platform makes no guarantee of its accuracy, legality, fitness for purpose or commercial value; you are responsible for evaluating it and bear the risk of using it.
  2. The Platform depends on third-party model providers, object storage, payment, SMS and other services. To the extent permitted by law, the Platform is not liable for service disruptions, delays or data loss caused by the interruption, change or termination of those services, force majeure, network failures or other causes outside its control.
  3. The Platform makes reasonable efforts to keep the service stable but does not guarantee uninterrupted or error-free operation. It may suspend the service temporarily for maintenance or upgrades and will try to give advance notice.

7. Changes and termination

  1. The Platform may revise these Terms as needed. Revisions are published on the Platform, may be accompanied by a version bump that asks you to confirm again, and take effect on publication.
  2. If you do not agree with a revision, stop using the Platform and, if you wish, request account deletion; continued use constitutes acceptance of the revised Terms.
  3. If you seriously breach these Terms, the Platform may terminate its services to you immediately without refunding remaining credits.

8. Governing law and disputes

The formation, validity, interpretation and dispute resolution of these Terms are governed by the laws of the People's Republic of China. Disputes should first be resolved through friendly negotiation; failing that, either party may bring an action before the competent people's court where the Platform's operator is located. If any provision is held invalid, the remaining provisions stay in force.
